Let down by a professional?

Let down by a professional? The traditional professionals such a lawyers,  accountants, doctors and others have no right to be free from blame when things go wrong. All the professions are judged by the standards set by their peers.

Professionals that do fall short should expect to be brought to account by clients and made to pay for the losses that they have caused.

Injury claims are quite common nowadays and the public have become quite adept at taking to task others who cause them injury. Dealing with a professional is much the same in terms of losses but the issue of liability (blame as the public would call it) is a little different.

To show that a professional has breached his duty to a client you have to look at what a reasonably competent professional in that same field would have done (setting aside any contractual duties that may exist).

For instance if a lawyer fails to obtain a detailed search prior to completing a purchase of a property and the property is later compulsorily purchased the client can seek advice from another lawyer who will tell him that a reasonably competent lawyer would have obtained a search. The lawyer is in breach of duty and if the amount obtained for the property when purchased by the local authority is less than he has paid for it then the client has a claim for the difference between the two prices.

If a reasonably competent accountant would have advised his client about claiming tax relief and he doesn’t then that client can claim his losses assuming that a reasonably competent accountant would have done so.

If a clinician fails to advise a patient to take a drug that could have cured a condition and that reasonably competent clinician would have so advised then the patient can look to the insurers of the clinician for the losses. These may be loss of earnings whilst off work ill or pain and suffering caused by not having taken the drug.
